Verta Limited Warranty

This Limited Warranty applies only to products specifically sold by Verta Corp (“Verta,” “we,” “us,” or “our”) with a Verta warranty. Manufacturer warranties applicable to third-party products remain subject to the terms provided by the applicable manufacturer.
Unless otherwise expressly stated in writing for a particular product, Verta provides the following limited warranty coverage.
1. Warranty Coverage
Subject to all terms, exclusions, conditions, and limitations contained in this Limited Warranty:
Frames and Structural Components
Verta warrants covered frames and structural components against defects in materials and workmanship for one (1) year from the original date of delivery.
Wear Parts and Components
Verta warrants covered wear parts and components against defects in materials and workmanship for ninety (90) days from the original date of delivery.
For purposes of this warranty, wear parts may include, as applicable, cables, belts, pulleys, bearings, bushings, grips, upholstery, pads, rollers, pop pins, adjustment mechanisms, hardware, and similar components that are naturally subject to deterioration through use.
Verta will determine the classification of a component as a frame, structural component, wear part, consumable component, or other component in its sole and reasonable discretion.
2. What This Warranty Covers
This Limited Warranty applies only to verified defects in materials or workmanship that arise during normal and intended use of the product during the applicable warranty period.
The existence of a malfunction, noise, cosmetic condition, worn component, or performance concern does not by itself establish the existence of a covered defect.
Verta will determine whether a claimed condition constitutes a covered warranty defect in its sole and reasonable discretion, subject to applicable law.
3. Verta’s Remedy
If Verta determines that a valid warranty claim exists, Verta will determine the appropriate remedy in its sole and reasonable discretion, subject to applicable law.
Verta may elect to:
Unless otherwise required by applicable law, Verta has the right to attempt repair or replacement before issuing a refund.
Replacement products or components may be new, refurbished, reconditioned, or functionally equivalent where legally permissible.
Any repaired or replaced component remains covered only for the remainder of the original applicable warranty period, unless Verta expressly provides otherwise in writing.
4. Warranty Claim Requirements
To request warranty service, the original purchaser must contact Verta within the applicable warranty period.
Verta may require:
Failure to provide reasonably requested information may prevent Verta from evaluating or approving the claim.
No repair, replacement, reimbursement, credit, or other warranty remedy is authorized until approved by Verta.
5. Used, Pre-Owned, Demo, Trade-In, Clearance, and Liquidation Equipment
Unless Verta expressly provides a separate written warranty for a specific item at the time of sale, all used, pre-owned, demonstration, trade-in, clearance, liquidation, refurbished, or previously used equipment is sold AS-IS, WHERE-IS, WITH ALL FAULTS, and WITHOUT VERTA’S 1-YEAR FRAME OR 90-DAY WEAR-PART WARRANTY, to the fullest extent permitted by applicable law.
The purchaser acknowledges that used equipment may contain ordinary wear, cosmetic damage, prior repairs, replacement components, worn components, surface corrosion, scratches, dents, fading, upholstery wear, mechanical wear, or other conditions consistent with age and prior use.
The purchaser is responsible for inspecting the equipment, or having the equipment independently inspected, before use.
If Verta elects, in its sole and reasonable discretion, to provide a warranty on a particular used product, only the warranty terms expressly stated in writing for that individual transaction will apply.
Any such accommodation does not create warranty coverage for other used equipment or future transactions.
6. Conditions Not Covered by Warranty
Verta’s Limited Warranty covers only defects in materials or workmanship determined by Verta to have existed during the applicable warranty period.
The warranty does not cover any damage, defect, failure, deterioration, malfunction, injury, loss, or other condition caused or contributed to by any of the following:
7. Effect of Improper Use, Modification, or Maintenance
A modification, repair, installation condition, maintenance issue, or other excluded condition will affect warranty coverage only to the extent permitted by applicable law and to the extent Verta determines that the condition caused, contributed to, accelerated, or prevented proper diagnosis of the claimed failure.
Verta may require photographs, video, maintenance records, installation information, usage information, inspection, or other reasonable documentation before making a warranty determination.
Except where applicable law requires otherwise, Verta retains sole and reasonable discretion to determine whether a claimed failure is covered by this warranty and whether an exclusion applies.
8. Commercial Use and Product Classification
Products must be used in a manner consistent with their intended classification.
Use of residential-rated equipment in a commercial, institutional, multifamily, public, or other high-use environment may exclude the product from warranty coverage unless Verta expressly approves such use in writing.
The purchaser is responsible for selecting equipment appropriate for the intended application.
9. Maintenance and Inspection Responsibilities
The owner is responsible for regularly inspecting and maintaining the equipment.
Equipment that is damaged, loose, excessively worn, unstable, malfunctioning, or otherwise potentially unsafe must immediately be removed from service until properly repaired.
Failure to perform reasonable inspection or maintenance may result in denial of warranty coverage where the failure caused or contributed to the claimed condition.
10. Labor, Shipping, and Service Costs
Unless Verta expressly agrees otherwise in writing, this Limited Warranty covers the defective product or component only.
Labor, diagnosis, disassembly, installation, removal, transportation, freight, shipping, travel, service calls, equipment rental, downtime, and similar costs are not covered unless Verta specifically authorizes them in writing or applicable law requires otherwise.
The customer may be responsible for shipping defective parts to Verta or another designated location for inspection.
Verta may elect, in its discretion, to provide prepaid shipping or otherwise cover transportation costs for an approved claim.
Unauthorized labor, service, repairs, shipping, or other expenses will not be reimbursed unless Verta approved the expense in writing beforehand.
11. Unauthorized Repairs and Modifications
Customers should contact Verta before performing repairs that relate to a potential warranty claim.
Unauthorized modification, repair, alteration, or replacement of components may result in denial of warranty coverage to the extent that the modification or repair caused or contributed to the claimed failure.
Nothing in this provision is intended to restrict rights that applicable law prohibits Verta from restricting.
12. Original Purchaser
Unless Verta expressly agrees otherwise in writing, this Limited Warranty is provided to the original purchaser of the product and applies to products purchased directly from Verta.
Warranty rights may not be transferred except where applicable law requires otherwise or Verta expressly authorizes the transfer in writing.
13. Third-Party Manufacturer Products
Products manufactured by third parties may be covered by warranties provided directly by their manufacturers.
Where applicable, Verta may assist the purchaser in submitting a manufacturer warranty claim, but Verta does not control and is not responsible for the manufacturer’s determination, response time, remedy, or performance.
A manufacturer’s warranty does not become a Verta warranty merely because Verta sold the product.
14. Limitation of Warranty
This Limited Warranty is limited to the coverage expressly described above.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY IMPLIED WARRANTIES THAT MAY NOT BE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION OF THE APPLICABLE EXPRESS WARRANTY PROVIDED ABOVE, WHERE SUCH A LIMITATION IS LEGALLY PERMITTED.
Some jurisdictions do not allow limitations on the duration of implied warranties, so the above limitation may not apply in every situation.
Nothing in this Limited Warranty eliminates or restricts any right that applicable law does not permit Verta to waive, disclaim, or limit.
15. Limitation of Damages
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VERTA WILL NOT BE RESPONSIBLE UNDER THIS LIMITED WARRANTY FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST MEMBERSHIP REVENUE, BUSINESS INTERRUPTION, LOSS OF USE, OR DOWNTIME.
Where legally permissible, Verta’s monetary liability arising under this Limited Warranty will not exceed the original amount actually paid to Verta for the affected product.
These limitations do not apply to liability that applicable law does not permit Verta to exclude or limit.
16. No Extension by Informal Statements
No employee, salesperson, contractor, representative, distributor, installer, or other person is authorized to expand or modify this Limited Warranty through oral statements, text messages, emails, marketing statements, or other informal communications.
Any modification or additional warranty commitment must be expressly authorized in writing by Verta.
17. No Guarantee of Continuous Operation
Verta does not guarantee uninterrupted or maintenance-free operation during the warranty period.
Fitness equipment contains components that naturally wear through use and may require adjustment, tightening, lubrication, maintenance, repair, or replacement during its service life.
The need for maintenance or replacement of a wear component does not necessarily constitute a defect.
18. Warranty Determinations
Except where applicable law requires otherwise, Verta retains sole and reasonable discretion to determine:
Verta’s decision to provide coverage, goodwill assistance, replacement, repair, reimbursement, credit, or another accommodation outside the terms of this warranty in one instance does not obligate Verta to do so in another.
19. Governing Terms
This Limited Warranty should be read together with Verta’s Terms & Conditions and Returns & Exchanges Policy.
If a conflict exists between this Limited Warranty and general website terms regarding an expressly covered warranty claim, this Limited Warranty will control with respect to that claim.
20. Rights That Cannot Be Waived
Nothing in this Limited Warranty is intended to waive, disclaim, restrict, or eliminate any consumer right, warranty, remedy, duty, or liability that applicable law does not permit to be waived, disclaimed, restricted, or eliminated.
Where applicable law conflicts with a provision of this Limited Warranty, applicable law will control only to the extent of that conflict.
